Agriculture Permit Transfers

An issued permit may be transferred to another person . To transfer a permit, a permittee must notify the Department in writing, using the Department's Agricultural Permit Transfer Request Form, that the permit is proposed to be transferred. This notification includes the name, address, and telephone number of the existing and proposed owners/operators. Also, any other information pertinent to the transfer that is not given on the Department's form should be included in the notification.

The Department has thirty days to grant the transfer, deny the transfer, or request additional information on either the transfer or the proposed owner/operator. The compliance history at other facilities owned by the proposed owner/operator will be a consideration in the decision to grant or deny the permit transfer. If the Department does not take action within thirty days of being notified, the transfer is approved by default and the transfer may occur without any further notice to the Department. However, if the Department requests additional information within the thirty-day period, the transfer cannot take place. When the Department receives the additional information, the Department again has thirty days to grant or deny the transfer or request additional information. Again, if the Department does not take any of these actions within thirty days of being notified, the transfer is approved by default and the transfer may occur without any further notice to the Department. Staff denial of a permit transfer may be appealed.
