On November 14, 2014, the Department issued a ninety-day regulation allowing the regulated community to submit Certificate of Need (CON) applications electronically. The Department now awaits General Assembly review of regulatory amendments making the web-based application permanent in the CON process. Until such review is complete, applications must again be in the paper format set forth in Regulation 61-15. Printouts or other reproductions of the web-based CON application will not be accepted.
Web-based CON applications submitted to the Department on or before February 10, 2015, are not affected by this announcement and will be processed in accordance with applicable law and regulations. Persons having submitted online applications on or before February 10th need not refile a paper-version of the submitted CON application. Those who have created and/or submitted online applications will continue to have access to their applications as they have had in the past, but will not be able to submit new applications electronically.
