EM Family Trust - Critical Area Permit Applications

The properties as originally public noticed under the ownership of the Dorothy R. Ayers Family Trust were purchased by Nathaniel Horton. Permit OCRM02376 was issued to Nathaniel Horton but it has since been transferred to EM Family Trust.


The original public notice advertised that the Dorothy R. Ayers Living Trust, and then purchased by Nathaniel Horton, proposed to construct two separate, private recreational docks located on Lot 96 and Lot 114 near 3rd Avenue and 5th Street, Mount Pleasant. 

The details for the two critical area permit applications are as follows:

  1. Critical Area Permit Application HNY-VVCT-3HS3X: WITHDRAWN

    Location: On and adjacent to Scanlonville Tidal Marsh at Lot 96 / 3rd Street, Mount Pleasant, Charleston County, South Carolina TMS: 5140500034

    Project Description: The work proposed consists of constructing a dock. Specifically, the applicant seeks to build a 4' x 490' walkway leading to a 10' x 12' fixed pierhead with benches and handrails. The work described is for private recreational use. 
  2. Critical Area Permit Application HNY-VWHC-QQFHM: ISSUED

    Location: On and adjacent to Scanlonville Tidal Marsh at Lot 114 / 3rd Street, Mount Pleasant, Charleston County, South Carolina TMS: 5140900045  

    Project Description: The work proposed consists of constructing a dock. Specifically, the applicant seeks to build a 4' x 410' walkway leading to a 10' x 12' fixed pierhead with benches and handrails. The work described is for private recreational use. 

After careful consideration of all comments and information received from concerned citizens, local and resource agencies, DHEC has determined that the dock structure, applied for by Nathaniel Horton, can comply with the Coastal Zone Management Act, the Department’s Critical Area Regulations and Coastal Zone Consistency certification review process. Having made this determination, DHEC’s Office of Ocean and Coastal Resource Management has issued the Critical Area Permit HNY-VWHC-QQFHM, OCRM02376. Virtual Public Hearing

DHEC held a virtual public hearing to receive comments on the proposed Horton Critical Area Permit Applications on September 28, 2020 at 6:00 pm. During the public hearing, DHEC staff provided a brief summary of the proposed action and accepted verbal and written comments to be considered prior to making a final decision.

Written comments were accepted September 14 - October 12, 2020. All comments that were received by the end of the notice period will be considered when making a decision to approve, disapprove, or modify the permits. This decision will be based upon consideration of applicable regulations, the permit applications, comments made at the public hearing and all other written comments received within the required time frame, and any other pertinent information. 

What to Expect After the Public Hearing

DHEC will review all written comments. DHEC’s final permit decision regarding Critical Area Permit Application HNY-VVCT-3HS3X will be made available on this webpage and by email or mail to everyone on DHEC’s mailing list who requested to be notified of the final decision for the proposed Horton Critical Area Permits.
